Fire Marshal to file charges in Lela fire When one fire leads to another, questions of liability and insurance coverage become complicated, according to Jasper Fire Marshal Stephen Williamson. Almost a year ago, a small white frame home on Lela Street was destroyed in a fire that started around midnight, June 22, and destroyed the home. No one was home, and while the cause was never determined, Williamson found no criminal intent. But a second fire occurred last week when workers were attempting to clear the wreckage by burning debris. What was left of the original home caught fire, and adjoining property was damaged. Williamson said this fire "did violate state laws and local ordinances. At this time I am still conducting interviews (from many witnesses) and obtaining statements." No charges have been filed yet, but Williamson said, "I do intend to file criminal charges against the person or persons determined to be responsible for this act." Williamson said his investigation may take up to six weeks to complete, but that it will "make a difference when this case comes to prosecution." It will also be complicated for insurance companies and the owners to sort out liability. Williamson said the insurance companies from adjoining property "are requesting justification for the damage caused by a previously burned home... Any criminal proceedings will have an effect on insurance, with the settlement on neighbors damage as well as the rates in our area. This is why the crime of arson hurts others." |
